CASE STUDY

WHITT LAW AND EXELON

In 2010 and again in 2011, Exelon Generation Company filed tax rate objection complaints against an elementary school district, alleging the unlawful accumulation of funds and seeking nearly $6 million in property tax refunds for each tax year. Exelon also filed similar tax objection complaints against the local high school district, alleging an unlawful accumulation of funds and seeking nearly $730,000 in property tax refunds for each tax year. With its comprehensive understanding of school finance, Whitt Law was able to implement a series of innovative financial procedures in order to prevail in the litigation and secure dismissal of the lawsuits against both clients. Simultaneously, Whitt also released previously restricted funds for the renovation and expansion of the local grade school.
