Communicating and Investigating Allegations of Employee Misconduct – School Districts Have Discretion But Walk a Fine Line

Whitt Law attorney Brian R. Bare was recently interviewed by the NPR station in Bloomington-Normal regarding school district investigations of employee misconduct and the tenured teacher dismissal process.  Parents in that area are reacting to news that a former first-grade teacher has been charged with sexually assaulting two students and was previously investigated for such allegations fourteen years ago.  Mr. Bare provided insight into the restrictions and concerns that school boards and administrators must navigate, which often limit the information that can be made public during an ongoing investigation.
